Terms of service
Last updated: [Publish date]
These terms are the agreement between you and Shoku LTD for your use of Shoku Social, which covers the website at shokusocial.com and the app at app.shokusocial.com.
- Company: Shoku LTD, registered in England and Wales, company number 16756983
- Registered office: 113–116 Bute Street, Cardiff, Wales, CF10 5EQ
- Contact: hello@shokusocial.com
Please read them before you sign up. Section 7 explains your right to cancel and when it ends. If you're using Shoku Social for a business, some sections apply differently, and we say where.
1. What Shoku Social does
Shoku Social uses AI to help you create social-media marketing: image ads, carousels, short videos with voiceover and subtitles, captions, and scheduled posts. Everything follows our halal content standard.
We keep improving the service, so features may change. We won't remove something you've paid for in the middle of your billing period without offering a fair alternative or a refund for the affected part.
2. Who can use it
- You must be 18 or over.
- If you sign up for a business, you confirm you're allowed to accept these terms on its behalf.
- Keep your email account secure, because that's how you sign in. You're responsible for activity on your account.
- One free plan per person or business. Creating several accounts to collect free credits isn't allowed.
3. Plans, credits and payment
Plans and credits
- Each plan gives you a monthly allowance of credits. Different actions cost different amounts. The current costs are shown in the app and on our pricing section before you spend anything.
- Plan credits reset at the start of each billing month and don't roll over.
- Top-up credits you buy separately last 12 months from purchase. The expiry date is shown before you buy.
- Refunds of credits: if a generation fails, or our content checks block it, the credits are returned to your balance automatically.
- No cash value: credits can't be exchanged for cash or transferred to anyone else.
Payment
- Paid plans renew automatically each month or year until you cancel. We'll remind you before an annual plan renews.
- Payments are processed by Stripe. For many purchases, Stripe's Link acts as the seller of record and will appear on your statement. [Confirm wording once Stripe Managed Payments is set up.]
- Prices shown to consumers include any VAT. [Confirm VAT presentation.]
- If a payment fails, we'll try again and email you. If it still can't be taken, your account moves to the free plan.
Price changes
We'll give at least 30 days' notice of a price change. It applies from your next renewal, and you can cancel before then.
4. Cancelling your plan
You can cancel online at any time in the app's billing settings. It takes no more than a couple of clicks.
When you cancel, your plan stays active until the end of the period you've paid for, then moves to the free plan. We don't refund part-used periods, except:
- as set out in section 7;
- where the law requires it.
5. The halal content standard and acceptable use
Shoku Social won't generate, and you must not try to make it generate:
- music, musical instruments or beat-like vocal effects;
- realistic human faces;
- immodest or sexual imagery;
- ads for alcohol, pork, gambling, tobacco or vaping, adult services, or interest-based lending;
- fake reviews or testimonials, invented statistics, or claims you can't back up;
- content that impersonates a real person or brand, or uses someone's likeness without permission;
- anything illegal, hateful, harassing, misleading about real-world events, or that infringes someone else's rights;
- political campaign content.
You also must not:
- try to get around our checks or the platforms' rules;
- use automated means to access the service, except features we provide;
- resell the service;
- use it to build a competing AI model;
- overload or attack our systems.
Our checks are careful but not perfect. We use automated checks and human review where needed, but we can't guarantee that every output matches every scholarly view. If you see something that shouldn't have got through, please use Report a problem and we'll act quickly.
We may block content, pause features, or suspend accounts that break these rules. Where it's fair to do so, we'll tell you why first.
6. Your content and the ads you make
What you give us
- You keep ownership of everything you upload: logos, photos, product images, text and your website content.
- You give us permission to use it only to provide Shoku Social to you: storing it, processing it, and sending it to our AI providers to create your results.
- You confirm you have the rights to anything you upload. That includes trademarks, photos and the permission of anyone shown.
What you make
- As far as the law allows, you own the ads you create, and we transfer to you any rights we have in them.
- AI-generated content may not be protected by copyright in every country, and similar outputs may be created for other people. We can't promise exclusivity.
- You can use your ads anywhere, including in paid advertising.
You're responsible for what you publish
- Review every ad before posting. Make sure it accurately shows your real products, prices and offers, and follows advertising rules: in the UK, the CAP Code enforced by the ASA.
- Using AI doesn't change who is responsible for an advert. We provide the tool; you're the advertiser.
AI labelling
- When we publish for you, we apply each platform's AI-content label where it's required.
- Exported files carry an invisible, machine-readable marker showing they were made with AI, as required by EU law.
- Don't remove these markers or hide that content is AI-generated where disclosure is required.
7. Your right to cancel (consumers)
If you're a consumer, you normally have 14 days from sign-up to cancel and get a refund.
- Our service is digital and starts straight away. At checkout we'll ask you to agree to immediate access and to confirm you understand you lose the 14-day right to cancel once the service is supplied.
- If you didn't use any credits, we'll still refund a cancellation within 14 days of first paying. Email hello@shokusocial.com.
This doesn't affect your statutory rights. If the service is faulty or not as described, you're entitled to have it fixed or to a refund under the Consumer Rights Act 2015.
8. Connected social accounts
- When you connect TikTok, Instagram, Facebook or YouTube, your use of those platforms is also covered by their own terms. For YouTube, that's the YouTube Terms of Service.
- We only post what you approve.
- Platforms set their own limits and can change or withdraw their APIs. When that happens, some scheduling features may not be available, and you can still download your ads to post yourself.
9. Availability
- We aim to keep Shoku Social available and working well, but we can't promise it will never be interrupted.
- We'll try to warn you about planned maintenance.
- Keep copies of any ads you need. Download them, or use your connected accounts.
10. Our responsibility to you
If you're a consumer
- We're responsible for loss or damage you suffer that's a foreseeable result of us breaking these terms or failing to use reasonable care and skill.
- We aren't responsible for loss that wasn't foreseeable, or for business losses: you agree to use the service for your own business or creative purposes, not as a guarantee of sales or results.
If you're a business
- We're not liable for loss of profit, revenue, business, goodwill or data, or for any indirect loss.
- Our total liability in any 12-month period is limited to the amount you paid us in that period.
For everyone
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.
11. Ending these terms
- You can close your account at any time in the app's settings.
- We can close your account:
- with 30 days' notice, for any reason, refunding unused paid periods;
- immediately, if you seriously or repeatedly break these terms.
- When your account closes, we delete your data as described in our privacy policy.
12. Changes to these terms
- If we make important changes, we'll email you at least 30 days before they apply.
- If you don't agree, you can cancel before then.
13. Complaints and disputes
- Please tell us first, using our complaints process.
- These terms are governed by the law of England and Wales.
- If you're a consumer living in Scotland or Northern Ireland, you can bring proceedings in your local courts.
- Otherwise, the courts of England and Wales have jurisdiction.
14. General
- These terms, together with our privacy and cookie policies, are the whole agreement between us.
- If a court finds part of them invalid, the rest still applies.
- If we don't enforce a right straight away, we can still enforce it later.
- We may transfer this agreement to another company if our business is sold. We'll tell you, and your rights won't be reduced.
